JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-08-2018 Heard learned counsel for the petitioner and counsel appearing on behalf of the State as well as university. Learned counsel for the petitioner submits that present writ petition is filed for payment of salary and enhance D.A. due from April 1981 to till date. Although, the writ petition was filed on 20.12.2013 but even after lapse of more than four years no step was taken by the respondents to file counter affidavit.

Under aforesaid circumstance counsel for the petitioner submits that petitioner may be granted liberty to file exhaustive representation addressed to the Vice-chancellor of the L.N.Mithila University, Darbhanga so that the grievance of

Patna High Court CWJC No.25439 of 2013(2) dt.14-08-2018 2/2 the petitioner with regard to payment of salary and enhance D.A. for the aforesaid period may be finally decided and arrears are paid to the petitioner within reasonable time. Accordingly, the writ petition is disposed of with liberty to the petitioner to file representation as indicated hereinabove. It shall be the obligation of the respondents to decide the representation if file by the petitioner and ensure payment of all admitted dues within maximum period of four months from the date of representation along with a copy of this order.
