The petitioner seeks bail in Special (POCSO) Case No. 19/2017, arising out of Araria (Mahila) P.S. Case No. 34/2017, instituted for offences under Section(s) 376, 341, 323, 379 and 506/34 of the Indian Penal Code read with Sections 8/12 of POCSO Act.

Learned counsel for the petitioner has submitted that occurrence is said to have taken place on 26.03.2017 and F.I.R. has been registered on 03.07.2017, after delay of about three months.

It is alleged in the written report that while informant was cutting grass nearby the house, this petitioner committed

Learned counsel for the petitioner has submitted that instant case has been filed only to put pressure on the petitioner for performing marriage with informant.

Petitioner is in custody since 17.01.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Addl. Sessionscum-Special Judge, Araria, in connection with Special (POCSO) Case No. 19/2017, arising out of Araria (Mahila) P.S. Case No. 34/2017, subject to the conditions that both the bailors shall be the close relative of the petitioner.
