JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 29-07-2021 Heard learned counsel for the appellant and learned Special P.P. for the State through virtual Court proceedings. Learned counsel for the appellant submits that in the court below all the witnesses have been examined and the case is fixed for Statement under Section 313 Cr.P.C. Vide order dated 25.06.2021, a status report was called for, which is kept at Flag 'M' whereby the learned Additional Sessions Judge-1st cum Special Judge SC/ST Act, Munger has reported that the case is fixed for recording statement under Section 313 Cr.P.C. but since the normal court proceeding is affected due to COVID-19 pandemic, the statement could not be recorded.

Considering the facts and circumstances of the case, I am not inclined to enlarge the appellant on bail.

Patna High Court CR. APP (SJ) No.2383 of 2021(3) dt.29-07-2021 2/2 Accordingly, the prayer for bail of the appellant is rejected. Accordingly, this appeal is dismissed.

The trial court is directed to conclude the trial within a period of six months from the date of receipt/production of a copy of the order.
