JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-08-2022 At the outset, counsel for petitioners seeks permission to withdraw the anticipatory bail application of petitioner no. 2 Parmeshwar Paswan @ Pannalal Paswan, as he has already been arrested.

The anticipatory bail application with respect to petitioner no. 2 Parmeshwar Paswan @ Pannalal Paswan is dismissed as withdrawn.

Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in Akbarpur

Patna High Court CR. MISC. No.17363 of 2022(2) dt.29-08-2022 2/2 P.S. Case No. 640 of 2021, registered for the offences punishable under Sections 341, 323, 325, 308/34 of the Indian Penal Code.

As per the FIR, petitioners are alleged to have assaulted, as a result of which four persons sustained injuries. It is submitted that petitioners have been falsely implicated in this case. There is general and omnibus allegation. Injuries sustained by the injured are simple in nature. Petitioners have got clean antecedents.

Considering the facts aforesaid, the petitioner nos. 1, 3 and 4 above-named, in the event of their arrest/surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Akbarpur P.S. Case No. 640 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
