The petitioner seeks bail in Special Case No. 03 of 2020, arising out of Sirdala P.S. Case No. 08 of 2020, registered for the offence under Section 20/22 of the N.D.P.S. Act. As per the F.I.R., 51 kg. of Ganja was recovered from the plot of Yamuna Yadav and Raghu Singh Bhokta respectively and it is alleged that the plots, from where alleged Ganja was recovered, were in possession of this petitioner. It is submitted on behalf of petitioner that petitioner is innocent and has been falsely implicated due to dirty village politics. There is nothing to substantiate that the land belongs to this petitioner and only on suspicion, he has been made accused. Co-accused Jamuna Yadav has already been granted bail, vide order dated 02.09.2021 passed in Cr.Misc. No. 22498 of 2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances as well as period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Nawada / concerned court in connection with Special Case No. 03 of 2020, arising out of Sirdala P.S. Case No. 08 of 2020.
