Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner apprehends his arrest in Karakat P.S. Case No. 107 of 2019, registered for the offences punishable under Sections 452, 380, 504, 506 and 34 of the Indian Penal Code.
Prosecution case in brief is that on 10.05.2019 at about 8.00 pm, all the accused persons including this petitioner committed dacoity in the house of informant and taken away ornaments and cash of Rs. 20,000/- from the purse. It is submitted that petitioner has been falsely
Patna High Court CR. MISC. No.15005 of 2020(2) dt.02-07-2020 2/2 implicated in this case due to previous enmity. There is general and omnibus allegation. In fact, this case has been lodged by the informant only to save his skin from the complaint case bearing no. 260 of 2019 filed by the co-accused Kailash Rai against the informant and others. Petitioner is a student. During course of investigation nothing has come against this petitioner. Petitioner is having clean antecedent.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bikramganj, Rohtas at Sasaram in connection with Karakat P.S. Case No. 107 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
