====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 23-06-2021 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State through video conferencing.

The petitioners have filed the instant application for grant of regular bail in connection with Barh P.S. Case no. 405 of 2020 registered under sections 307, 341, 323, 504, 506 and 34 of the Indian Penal Code and section 27 of the Arms Act. As per the allegation in the F.I.R., it is stated that as a result of dispute between Ramanand Singh and Satyaprakash Yadav, the accused persons including the petitioners herein variously armed reached there. On the orders of Satyaprakash Yadav and Vinod Yadav, the accused persons started to fire

Patna High Court CR. MISC. No.22033 of 2021(3) dt.23-06-2021 2/3 indiscriminately. On the informant asking them not to fire, it is stated that Aman Kumar fired hitting the informant in his right leg. The informant was taken for treatment.

It is submitted by learned counsel for the petitioner that the allegations as levelled in the FIR are false and concocted. The petitioners have been falsely implicated in the case. The allegations are general and omnibus in nature. The only specific allegation is against Aman Kumar. Further referring to the injury report of the informant which has been brought on record by the petitioner in the supplementary affidavit, it is submitted that the injury contained therein corresponds to the allegations made against coaccused Aman Kumar. The petitioners are in custody since 8.12.2020 and 11.12.2020 respectively and the petitioner no.2 has no criminal antecedent.

The application for bail is opposed by learned Additional Public Prosecutor for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioners, the petitioners are directed to be enlarged on bail in connection with Barh P.S. Case no. 405 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with
