The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 302, 201, 120B/34 of the Indian Penal Code.

On recovery of a dead body FIR was lodged against unknown.

It is submitted that petitioner is not named in the FIR. Name of petitioner transpired in this case during course of investigation. As a matter of fact, the deceased was killed by some other persons. This petitioner has been made accused in this case only on suspicion. Petitioner has got no concern with his wife co-accused Sushma and is living at Delhi since long. Even this petitioner was not present on the alleged date and time of occurrence. In the entire investigation, no direct or indirect

Only material against this petitioner is that petitioner is first husband of the co-accused Sushma Devi and the deceased was second husband of Sushma Devi and because of that petitioner is suspected to be involved in the murder of deceased. Petitioner claims clean antecedent. Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Baligaon P.S. Case No. 136 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
