Patna High Court C.R. No.116 of 2016 dt.01-05-2017 ORAL JUDGMENT Date: 01-05-2017 Heard Mr. Thakur, learned counsel appearing for the petitioner.
The present revision application has been filed by the plaintiff being aggrieved by the impugned order by which the learned court below has accepted the counter claim filed by the defendants for consideration. The suit has been filed by the plaintiff against the transfer by sale deed executed by defendant no.6 and 7 in favour of defendant nos.1 to 5. The defendant nos. 1 to 5 have thereafter filed counter claim praying for partition of their share in the suit property. The same has been accepted for consideration by the learned court below.
After careful consideration of the matter as well as the submission, this Court does not find that the learned court below has committed error of jurisdiction or material irregularity in passing the impugned order.
The application is, accordingly, dismissed.
