JUSTICE SUDHIR SINGH ORAL ORDER 22-07-2015 The petitioner is apprehending his arrest in connection with Asarganj P.S. Case No. 14 of 2015 for the offences instituted under Sections 302/34 of the IPC.
Heard learned counsel for the petitioner and learned counsel for the State.
It is alleged that accused Anoj Singh, Amar Singh and this petitioner assaulted the wife of the informant with dagger as a result of which she died.
It has been submitted on behalf of the petitioner that the general and omnibus allegation has been made against the petitioner. No specific injury has been attributed against the petitioner.
On behalf of the State it has been submitted that the
Patna High Court Cr.Misc. No.27391 of 2015 (2) dt.22-07-2015 2/2 allegation of assault is there upon the petitioner and from perusal of the post mortem report, it appears that there are four injuries sustained on the body of the deceased.
Considering the aforesaid facts and circumstances, I am not inclined to grant anticipatory bail to the petitioner. The same is rejected in Asarganj P.S. Case No. 14/2015 , pending in the court of the learned J.M. Ist Class, Munger. Anyhow, if the petitioner surrenders in the court below within a period of four weeks from the date of receipt/production of copy of this order the case of the petitioner shall be considered on its own merit without being prejudiced by this order.
