The petitioner seeks bail in a case registered for offences under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 13 litres of "Kachi Daru" was recovered from the joint possession of the petitioner along with co-accused Rakesh Dhankar @ Rakesh Shankar. It is urged that the petitioner has remained in custody since 26.09.2017, i.e., for about two months. It is claimed that the petitioner is having clean antecedent.

No.55683 of 2017(2) dt.23-11-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-II-cumSpecial Judge, Excise Act, Sitamarhi in connection with Complaint Case No. C2-539 of 2017 with a condition that if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
