Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Agamkuan P.S. Case No. 693 of 2022 dated 08.09.2022 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

The main submissions advanced by learned counsel for petitioner are that the instant matter relates to the recovery of 120.570 litres of country-made foreign liquor and the same is stated to have been recovered from the petitioner's house but in actual, the said house had been rented out by this petitioner to co-accused person Sanjeev Kumar who was the tenant and in this regard a rent agreement was also prepared and at the time of recovery the said tenant and Ravikant Kumar were found at the

Patna High Court CR. MISC. No.26099 of 2023(2) dt.16-05-2023 2/2 petitioner's house and they in order to save themselves, revealed the name of this petitioner who has fair and clean antecedent and has been languishing in jail since 28.02.2023 and against him the investigation has been completed.

Learned APP for the State opposes the bail prayer of the petitioner.

Considering the above submissions and mainly the petitioner's fair and clean antecedent and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of concerned Court in connection with Agamkuan P.S. Case No. 693 of 2022.
