JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 20, 22 of N.D.P.S. Act. 150 gm. ganja is said to have been recovered from the shop of the petitioner, against whom there is allegation that he used to supply ganja to others.

Submission on behalf of the petitioner is that socalled recovery comes under the definition of small quantity and moreover, prior to institution of this case, no case for the offence of N.D.P.S. Act had been lodged against the petitioner. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.43597 of 2018 (2) dt.20-07-2018 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Bhagalpur in connection with Sanhaula P.S. Case No. 96 of 2018.
