2. The petitioners are apprehending their arrest in connection with Karakat P.S. Case No. 02 of 2023 for the offence under Sections 341, 323, 504, 324, 307 and 34 of the I.P.C. lodged on 04.01.2023 by the informant, Jai Prakash Singh.

3. As per the prosecution story, the informant alleged that on the issue of payment regarding to buffalo, assault took place, in which, allegation against these petitioners is of assaulting on the head of Jangi Singh and Sandesh Singh on the head. Accordingly, the FIR.

4. Learned counsel for the petitioners submit that

Patna High Court CR. MISC. No.19969 of 2024(2) dt.02-04-2024 2/2 though allegation of assault is there, there is a case and counter-case and they do not have criminal antecedent.

5. Learned APP on the other hand has drawn the attention of this Court to the observations of the learned Sessions Judge to show that number of fractures have been found on the head of Jangi Singh as also Om Prakash.

6. Considering the aforesaid fact it would be appropriate that the petitioners seek bail.

7. Accordingly, the anticipatory bail application stands rejected.

8. However, if the petitioners surrender within a period of four weeks from today, the Court concerned shall take up the matter and dispose of the same preferably on the same day.
