JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-10-2017 The petitioners seek regular bail in connection with Hajipur Sadar P.S. Case No. 200 of 2017, registered for offences punishable under Sections 147, 148, 149, 341, 323, 337, 338, 307 and 302 of the Indian Penal Code.

Earlier prayer for bail of the petitioners was disposed of with liberty to the petitioners that they may renew their prayer for bail after framing of charge in this case.

It has been submitted by learned counsel for the petitioners in this case now charge has been framed and there is no likelihood of conclusion of trial in near future as no witness has been examined uptil now and petitioner no. 1 is an old person aged about 70 years and petitioner no. 2 is lady and save and except

Patna High Court Cr.Misc. No.49062 of 2017 (2) dt.11-10-2017 confession, there is nothing against the petitioners. Heard learned A.P.P. also.

Having heard both sides, in view of the submissions of learned counsel for the petitioners, this application is disposed of with direction to the trial court to verify the submission of learned counsel for the petitioners that save and except confession, there is nothing against the petitioners and if it is true, the trial court shall release the petitioners on bail to his own satisfaction with condition that they will cooperate in disposal of trial and will appear on each and every date, failing which, their bail bonds shall be liable to be cancelled.
