The petitioner has filed the instant application for grant of regular bail in connection with Kochadhaman P.S. Case no. 309 of 2019 registered for offence under sections 25(1-B)(a) and 26 of the Arms Act.

As per allegation in the F.I.R., on search of the petitioner who was on a motorcycle, a loaded country made pistol was recovered from his waist and he also did not produce any paper for the motorcycle.

It is submitted by learned counsel for the petitioner that the allegation as leveled in the F.I.R. are false and concocted. No incriminating material has been recovered from his possession. He has no criminal antecedent under the Arms Act

Patna High Court CR. MISC. No.15045 of 2020(3) dt.01-06-2020 2/2 and is in custody since 19.12.2019.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the fact of the petitioner being in custody since 19.12.2019, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Kochadhaman P.S. Case no. 309 of 2019 on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj.
