The petitioner seeks bail in a case registered for offence under sections 457, 380, 411 and 34 of the IPC. FIR alleges a theft in the night in the house of the informant.

Counsel for the petitioner submits that merely because he is a resident of a nearby tola his name has been taken in the instant case on the basis of suspicion. Nothing has been recovered from his possession to connect him with the theft in question. Petitioner is in custody since 2.6.2017 having no antecedent. Investigation has been completed and the charge sheet has been submitted.

In the facts of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as mentioned above, be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl.Chief Judicial Magistrate, Benipatti Madhubani Benipatti Police Station Case No. 166 of 2016 on the

No.60211 of 2017 (2) dt.20-12-2017 following conditions:- (a) One of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with him. The bailor will also undertake to inform the court if there is any change in the address of the petitioner. (b) The petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
