Heard the parties.

Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 342, 307, 302, 120(B), 379 & 34 of IPC and Section 27 of the Arms Act. Learned counsel for the petitioner submits that no overt-act is alleged against the petitioner.

Learned counsel for the informant opposed the prayer for bail on different grounds including on the ground that one of the assailants has been refused bail by a Coordinate Bench of this Court.

Since there is no overtact alleged against the petitioner, who is in custody since 27.11.2020, there is no reason for further detention of the petitioner as undertrial prisoner after completion of investigation, hence, let the

No.27471 of 2021(2) dt.04-10-2021 2/2 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Birpur P.S.Case No.85 of 2020 with following conditions:

(a) Both the bailors shall be resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
