ANJANA MISHRA ORAL ORDER 11-08-2015 At the outset, learned counsel for the petitioners submits that during the pendency of the present application, petitioner No.2 Babulal Singh has already been taken into custody. Permission is thus sought for withdrawing the application on his behalf.
Liberty is granted.
The application on behalf of petitioner No.2 Babulal Singh is, accordingly, dismissed as withdrawn. Heard learned counsel for the petitioners and the learned counsel for the State.
Petitioner Nos.1, 3, 4 and 5 are apprehending their
Patna High Court Cr.Misc. No.30414 of 2015 (2) dt.11-08-2015 2/2 arrest in connection with Kaler P.S. Case No.21 of 2015 for allegedly having committed the offences under Sections 147, 148, 149, 447, 448, 504, 506, 323, 324, 307 and 337 of the Indian Penal Code.
Learned counsel for the petitioners submits that the present case has arisen out of the land dispute and the informant's sides are agnates and their houses are joint, which resulted in some altercation.
Considering the aforementioned submissions and the nature of allegations, let petitioner No.1, 3, 4 and 5, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jehanabad, in connection with Kaler P.S. Case No.21 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
