The petitioner is in custody in connection with Rahika P.S. Case No. 115 of 2018 (CRI Case No. 2120/2018), registered for the offence punishable under Sections 420, 379,34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 18.10.2018. Referring to the prosecution case, he submits that allegation against this petitioner is that he was among the boys who were standing behind the informant to enter the ATM for withdrawal of cash. It is alleged that petitioner and others have exchanged the ATM Card of the informant by furnishing her the ATM Card of Sobha Devi. Initially this case registered against
Patna High Court CR. MISC. No.16947 of 2019(2) dt.25-03-2019 2/2 unknown and later on petitioner has been made accused in the instant case.
Considering the fact that petitioner was apprehended by the police on 18.10.2018 but has not been put on TIP as yet and the petitioner has no criminal antecedent, this Court is inclined to grant bail to the petitioner. Let, the petitioner named above be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., 1st Madhubani in connection with Rahika P.S.
