1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Barhara P.S. Case no. 437 of 2019 registered under sections 307, 147, 341 and 323 of the Indian Penal Code.

3. As per the prosecution case, the informant states that over a dispute, Pramod Bind came and assaulted her with a lathi as a result of which she sustained injuries in her right hand. It is stated that six named accused persons came and assaulted her husband as a result of which he fell down. It is further stated that Pramod Bind assaulted with a khanti on the head of her son Ranjeet Bind as a result of which he sustained injuries in his

Patna High Court CR. MISC. No.20171 of 2024(2) dt.02-04-2024 2/3 head. Further Kamlesh Bind assaulted with a rod also injuring her son. The informant further states that other accused persons also assaulted with different objects.

4. It is submitted by learned counsel for the petitioner that there is case and counter case between the parties. The correct version having been narrated in the FIR brought on record as Annexure-3 to the petition registered by the father of the petitioner. With respect to the other injured, learned counsel for the petitioner submits that on a query by the Investigating Officer, the informant replied that the injury reports of others was not available. It is stated that so far as the allegation of assault on the deceased is concerned, the same is general and omnibus in nature. The petitioner is in custody since 19.10.2023 and chargesheet has been submitted in the case.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the contents of the petition, the allegation against the petitioner being general and omnibus in nature, his being in custody since 19.10.2023 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Barhara P.S. Case no. 437 of 2019 on furnishing bail bond of
