The petitioners seek bail in a case registered under Sections 413, 414/34 of the Indian Penal Code. Allegation is that the while informant along with other police force were on patrolling duty, they saw that the petitioners were trying to open the motorcycle. On seeing the police party the petitioners tried to flee away but they were caught. The informant seized a motorcycle, mobile and a master key from both the petitioners.

It has been submitted on behalf of the petitioners that the petitioners are in custody since 06.11.2018 and have got no

Patna High Court CR. MISC. No.21504 of 2019(3) dt.08-05-2019 2/2 criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioners had no knowledge that the motorcycle in question is stolen property. On behalf of the State, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss Divya Amal, J.M. 1st class, Patna in connection with Kotwali P.S. case No.772 of 2018.
