2. The petitioners apprehend their arrest in a case registered for the offence punishable under Sections 126(2), 115, 117, 109, 118(1), 303(2), 352, 351(2)(3) and 3(5) of the
Patna High Court CR. MISC. No.17589 of 2025(2) dt.08-04-2025 2/3 B.N.S..

As per prosecution case, informant, namely Vijay Rai, alleged that on 10.12.2024 at about 4 PM, Petitioner No. 6 was driving tractor rashly with loud obscene music near house of informant and when his son objected, he was abused. It is further alleged that later at 5 PM, Petitioner No. 6 along with all the F.I.R. named accused persons, including these petitioners, attacked informant and one Munna Rai by means of rods and sticks causing severe injuries and also snatched gold chain and Rs. 7,800/- cash from informant.
4. It is submitted by learned counsel appearing on behalf of the petitioners that petitioners are quite innocent and have committed no offence. As a matter of fact, a quarrel took place between the parties over petty dispute of playing D.J., which led to a free fight in which both sides sustained injuries. There is case and counter-case between the parties. Allegation of assault is general and omnibus allegations and there is no specific accusation of overt act against these petitioners. Doctor has found the injuries, allegedly caused by these petitioners, to be simple in nature.
5. Learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed
Patna High Court CR. MISC. No.17589 of 2025(2) dt.08-04-2025 3/3 the prayer for grant of anticipatory bail to the petitioners.
6. Considering the general and omnibus nature of accusation, nature of injuries sustained by the injured and case and counter-case between the parties, the prayer for grant of anticipatory bail to these petitioners is allowed.
7. Accordingly, in the event of arrest/surrender within a period of eight weeks from today, let the above named petitioners be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Saran at Chapra in connection with Doriganj P.S. Case No. 320 of 2024, subject to condition as laid down under Section 482(2) of the B.N.S.S..
