JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-07-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the first information report and the impugned order goes to show that name of this petitioner surfaced in confessional statement of co-accused. Petitioner does not have any criminal antecedent and is languishing in jail custody since 03.02.2018 but up till now, he has not been put on Test Identification Parade.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on
Patna High Court Cr.Misc. No.43611 of 2018 (2) dt.20-07-2018 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-X, Bhagalpur in connection with Sabour P.S. Case No. 12 of 2017.
