The petitioner being the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 498A of the Indian Penal Code and 3/4 of Dowry Prohibition Act. The basic accusation is of torture for nonfulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that the petitioner is ready to keep the informant as wife with full dignity and honour and making payment of the maintenance amount of Rs.2500/- as directed by the learned

Patna High Court Cr.Misc. No.7958 of 2015 (6) dt.30-10-2015 2/2 court below in Maintenance Case No. 1010 of 2014. Counsel for the informant submits that the informant is not ready to accept the offer of the petitioner since the petitioner has performed second marriage. Considering the above submissions and the fact that the petitioner is making payment of maintenance amount as directed by the learned court below, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Amdabad P.S. Case No. 79 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
