The appellant is apprehending his arrest in connection with Kutumba P.S.Case No.209 of 2018 , registered for offences punishable under Sections 452, 506, 504, 354/34 of the Indian Penal Code, Section 8 of POSCO Act and Section 3(1)(s)/3(2) (va) of SC/ST (Prevention of Atrocities) Act. Allegation against the appellant is that he along with others entered forcibly inside the house of the informant in drunken condition and caught hold to the informant and on hulla, they threatened and abused by caste name. Submission of the learned counsel for the appellants is that the whole allegation is false and concocted and now both the parties have compromised the case also.

Heard learned Special P.P.

Having heard both sides, considering the facts and circumstances of the case, I am not inclined to grant privilege of anticipatory bail rather let the appellant

Patna High Court CR. APP (SJ) No.1067 of 2019 dt.15-04-2019 2/2 surrender before the learned Special Judge within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned special judge on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day. Accordingly, this appeal is disposed of.
