This is the third attempt of the petitioner to obtain regular bail in connection with Sessions Trial No. 130 of 2020 arising out of Chhapra Muffasil P.S. Case No. 224 of 2019 registered for the offences punishable under Sections 302/34 of the Indian Penal Code. The petitioner has no criminal antecedent and has remained in custody since 21.08.2019.
Earlier prayer for bail of the petitioner was twice rejected after noticing the materials and the accusations against the petitioner. The petitioner is said to have given repeated knife blow causing death of the brother of the informant. Perused the report dated 13.10.2022 of learned Additional Sessions Judge, XIII Saran at Chapra at Flag 'B'. From the report, it appears that all the seven chargesheet witnesses have

Having regard to the report received from the learned Additional District and Sessions Judge, XIII Saran at Chapra at Flag 'B' saying that all the prosecution witnesses have been examined and the trial is likely to be concluded within a period of three months, this application is being disposed of with a direction to the learned trial court to conclude the trial within the aforesaid period by keeping records on day-to-day basis.
