Considering the facts of the case and direct nature of allegation supported by medical evidence, the prayer for anticipatory bail is refused.

However, if the petitioner surrenders in the court below and prays for regular bail, it has to be considered without being prejudiced towards the petitioner for approaching this Court as well under Section 438 Cr.P.C. in connection with Khaira P.S.Case No. 43 of 2014, pending in the court of Judicial Magistrate, 1st Class, Jamui.
