2. Despite repeated calls, none appears on behalf of the appellants, whereas Mr. Dilip Kumar Sinha, learned Additional Public Prosecutor for the State is present.

3. Perusal of record shows that vide letter dated 23.05.2025 of Assistant Registrar, Criminal Appeal Section of this Court, a living status report of accused appellants was called for. In response thereto, Superintendent of Police, Rohtas submitted a report dated 23.07.2025 based on the information

Patna High Court CR. APP (DB) No.179 of 1997(5) dt.16-12-2025 2/2 furnished by Station House Officer, Nokha Police Station apprising this Court that the appellant Nos. 1, 2 & 3, namely, Babulal Choudhary @ Rana Chaudhary, Lallan Choudhary @ Gaju and Badri Narayan Choudhary @ Badri Choudhary, respectively have died during the pendency of this Criminal Appeal.

4. In view of the above, the Criminal Appeal qua appellant Nos. 1, 2 & 3, namely, Babulal Choudhary @ Rana Chaudhary, Lallan Choudhary @ Gaju and Badri Narayan Choudhary @ Badri Choudhary, respectively stands abated.
