Mr.Nirmal Kumar Sinha, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-09-2020 Heard the learned counsel for the petitioner and Sri Nirmal Kumar, the learned APP for the State.
The petitioner seeks regular bail in connection with Siwan Town P.S. Case No. 454 of 2019, registered for the offence punishable under Sections 461, 379, 511 and 427 of the Indian Penal Code.
The allegation is regarding commission of theft in the civil court premises in three courts, after breaking the grill of the windows and also damaging the CCTV cameras. During investigation, the petitioner and other accused persons have
Patna High Court CR. MISC. No.15506 of 2020(5) dt.03-09-2020 2/2 been identified on the basis of the CCTV footage. The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case and he is languishing in custody since 04.10.2019. It is further submitted that only because, the petitioner is having a bad criminal antecedent, he has been falsely implicated in the present case.
Per contra, the learned APP has vehemently opposed the prayer for bail.
Having regard to the facts and circumstances of the case, considering the submissions made by the leaned counsel for the petitioner and taking into account the materials available in the case diary, the complicity of the petitioner in the alleged crime is writ large on the records, hence, I do not deem it fit and proper to entertain the prayer of the petitioner for regular bail, thus, the present petition stands dismissed.
