The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323 and 504 of the Indian Penal Code and under Sections 3(i)(x) of the SC/ST Act.
The informant made allegation that while he went to save the B.D.O., the petitioner and others abused and assaulted him.
It is submitted that similarly situated accused Guddu Singh @ Guddu Kumar Singh & Ors and Bhola Prasad moved for anticipatory bail in Cr. Misc. No. 17161 of 2015 and in Cr. Misc. No. 22179 of 2015. The aforesaid cases were disposed of with a direction to surrender in the court below and the learned Chief
Patna High Court Cr.Misc. No.27485 of 2015 (4) dt.08-12-2015 2/2 Judicial Magistrate shall dispose of the regular bail petition of the petitioners of the aforesaid cases in the light of the observations made therein. The petitioners of the aforesaid cases have already been enlarged on bail and the case of the petitioner stands on the similar footing.
Considering the facts aforesaid, the petitioner above named is directed to surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and the learned court below shall pass order considering the fact that the similarly situated co-accused have already been enlarged on bail in view of the observations made in the aforesaid cases and dispose of the bail petition on the same day.
