The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 307, 324, 326, 379, 504 and 506 of the Indian Penal Code. The prosecution case is that the petitioner assaulted with Fasuli (a sharp cutting weapon) to the informant, who happens to be brother-in-law (Sarhu) of the petitioner. It is submitted by learned counsel for the petitioner that the informant has been found to be simple in nature and the accusation has been levelled since the wife of petitioner has lodged Gaya Mahila P.S. Case No. 28 of 2013 under Sections 498A/34 of the IPC at the instigation of the informant.
Patna High Court Cr.Misc. No.23761 of 2016 (2) dt.26-05-2016 2/2 The aforesaid facts constitute ground for consideration of prayer for regular bail by the learned court below, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Belaganj P.S. Case No. 43 of 2016 pending in the court of learned Chief Judicial Magistrate, Gaya.
With the aforesaid observation, this application is disposed of.
