JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-03-2019 The petitioner seeks bail in anticipation of his arrest in connection with Jhajha P.S. Case No. 137 of 2017, dated 28.05.2017, instituted for the offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1b)A, 26 and 35 of the Arms Act. The name of the petitioner has transpired in the confession of an arrested accused person. There does not appear to be any recovery from the possession of the

Patna High Court CR. MISC. No.17874 of 2019(2) dt.29-03-2019 2/2 petitioner. The earlier case in which the petitioner has been made accused, reference of which has been made in paragraph 3 of the bail application, is also a case where the petitioner was not named and was made accused on the basis of confession of an arrested accused person. In that case also, the petitioner is on bail.

Considering the facts aforestated, the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jamui, in connection with Jhajha P.S. Case No. 137 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
