(i) That the petitioner is filing the present writ petition before this Hon'ble High Court for issuance of writ of Mandamus, directing /commanding the respondent authorities to grant the petitioner the benefit and make the payment of monetary benefit of 3rd Modified Assured Career Progression scheme (hereinafter referred as 3rd MACP in

Patna High Court CWJC No.5076 of 2022(2) dt.29-11-2023 2/2 short) w.e.f. respective due dates within consequential benefits thereof.

(ii) That the petitioner is further praying before this Hon'ble Court for issuance of further writ of Mandamus directing/commanding the respondent authorities to make the payment with the penal interest @ 18% per annum from the date of due till the date of actual payment."

At the outset, the learned counsel for the respondent-State submits that the petitioner has already been granted the benefit of 3rd MACP with effect from 27.09.2009 and in case any monetary benefits are due to be paid, the same would definitely be paid within a period of four weeks from today.

It is directed accordingly.

The writ petition stands disposed off.
