The petitioner, already in custody, seeks bail in connection with Warisnagar P.S.Case No. 212 of 2015 registered under Sections 302 and 201/34 of the Indian penal Code. Its case of a dead body being found after a person being killed and thrown by the road side.

Learned counsel for the petitioner submits that FIR is against unknown and only material transpired during investigation against the accused persons is that by call details of C.D.R., location of the mobile of the petitioner was found near the place of occurrence and the spy disclosed that they were seen near the occurrence in the said night. However,

Patna High Court Cr.Misc. No.43295 of 2018(2) dt.18-07-2018 2/2 similarly situated another co-accused Manish Kumar Jha has been granted bail by a co-ordinate Bench of this Court vide Cr. Misc. No. 30453 of 2018 and this this petitioner has clean antecedent.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Rajan Kumar @ Rajan Kumar Choudhary @ Rajan Kr. Chy. is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Samastipur in connection with Warisnagar P.S. Case No. 212 of 2015.
