The petitioner is in custody in connection with Mojahidpur (Babarganj) P.S. Case No. 255 of 2018 for the offence under Section 392 of the Indian Penal Code later on converted under Section 395 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. Learned counsel for the petitioner further submits that initially F.I.R was lodged against unknown. Learned counsel for the petitioner further submits it is alleged that informant saw the face of the miscreants and can also identify the miscreants. Learned counsel for the petitioner submits that petitioner is 40 years old and he was apprehended by the police on 06.12.2018 but petitioner has not been put on

Considering the fact that the petitioner has no criminal antecedent and petitioner was not named in the F.I.R. and petitioner has not been put on T.I.P. for establishing his identification, the Court is inclined to grant bail to the petitioner. Let, the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Mojahidpur ( Babarganj) P.S.
