JUSTICE ARUN KUMAR ORAL ORDER 26-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 9.6.2018, seeks bail in Laukahi PS Case No. 32 of 2017 registered under Sections 147, 148, 149, 341, 323, 324, 307, 436, 427, 447 and 504 of the IPC. The allegation in brief is that due to land dispute all accused persons came to the house of the informant, assaulted him and one Budhan Yadav set fire in the house of the informant. Learned Counsel for the petitioner submits that there is land dispute between both sides and there is case and counter case also, there is general and omnibus allegation of assault against so many persons but only two injuries were found on the persons and that too are simple in nature and there is no allegation against the petitioner of setting fire in the house of the informant rather the same is specific against one Budhan Yadav.

Having considered the said facts and circumstances, the petitioner, namely, Baiju Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of SDJM Jhanjharpur, Madhubani in connection with Laukahi PS Case No. 32 of 2017.
