The petitioner seeks bail in a case registered under Sections 328, 376, 506/34 of the Indian Penal Code and Section 4 of POCSO Act.

Allegation is that the petitioner molested and committed rape upon the victim.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 09.10.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The alleged date of occurrence is 04.10.2018 and the case was instituted on 08.10.2018. Delay has not been explained by the prosecution. A counter case was also

Patna High Court CR. MISC. No.18901 of 2019(4) dt.17-05-2019 2/2 instituted by the petitioner, which is Annexure 2 to the present application. Said case was instituted on 08.10.2018 in relating to an occurrence which had taken place on 08.10.2018. Said case was instituted for an offence under Sections 384 and 379 of I.P.C. The present case is outcome of Annexure 2 to the present application. The medical examination report also does not support the allegations made in the F.I.R.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cum-Special Court, SC/ST, Rohtas at Sasaram in connection with POCSO case No.70 of 2018 arising out of Dinara P.S. case No.389 of 2018.
