The only issue left now is a deduction of Rs.49324.70 made form the petitioner's retiral dues etc. because he did not account for certain materials such as different sizes of iron rods etc. when he handed over charge at the time of superannuation. Opportunity was given to the petitioner to account for or pay the cost of the missing or unaccounted inventory.
Except for bald denial, no explanation as such was offered by the petitioner for the missing items from the stock. That is the reason why such deduction has been made.
Patna High Court CWJC No.14882 of 2014 dt.20-08-2016 2/2 If the petitioner can even account for the same at this stage also, the respondents will surely reconsider the deduction. There is certain period, which is 1975 to 1982, when the petitioner was posted at Jhumari Tillaiya and payment of GPF has not been made by the State of Bihar because details of deduction are not available with them. It is evident from the communication dated 26.11.25015 addressed to the Executive Engineer, Jhumari Tillaiya that he has been requested to furnish the details and series of letters have been written to him for which no response is coming. It is a rather unfortunate situation. Let the Principal Secretary, PHED, Government of Jharkhand, Ranchi look into the matter and issue appropriate direction so that a retired government servant is not harassed for his rightful claim.
The writ application stands disposed of with the above direction.
