2. Petitioner is accused in connection with Sessions Turkauliya P.S. Case No. 212 of 2023, G.R. No. 1084 of 2023 registered under Sections 304 and 34 of the Indian Penal Code.

3. It is alleged that the daughter of the informant died due to the negligence of the petitioner during course of operation.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case merely on suspicion. The daughter of the informant died at Dr. Niranjan Singh Hospital during operation and her death did not occur due to negligence committed by the petitioner and, as such, no case under Section 304 of the IPC is

The petitioner did not give any medical treatment to the deceased and also not prescribed any medicine. Petitioner has got no criminal antecedent. He is under custody since 16.12.2023.

Having considered the above facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkauliya P.S. Case No. 212 of 2023, G.R. No. 1084 of 2023.
