This is an application for bail in connection with Special Case No. 17 of 2016, arising out of Tarabari P.S.Case No. 34 of 2016, registered for the offences punishable under Sections 20, 22, 23 and 24 of N.D.P.S. Act.

Allegation is that 30 kg. of ganja has been recovered from the vehicle and persons present there disclosed the name of the petitioner who sold the same to them and from the house of the petitioner ganja was also recovered for which separate case has been lodged. Further it appears that petitioner is accused in other cases also.

Submission of learned counsel for the petitioner is that so far present case is concerned, there is absolutely nothing against

Patna High Court Cr.Misc. No.50419 of 2017 (3) dt.17-11-2017 2/2 him as recovery has been made from other accused persons and not from the petitioner and he is in custody since 7.6.2016. Heard learned APP also, who has opposed the prayer for bail stating that huge quantity of ganja has been recovered. Having heard both sides and in view of facts and circumstances, I am not inclined to grant bail to the petitioner. Hence, prayer for bail is rejected.
