JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-08-2018 Heard the parties. The petitioner seeks anticipatory bail in connection with Jokihat P.S. Case No.326 of 2016, registered for offences punishable under Sections 467, 468, 471, 409 and 420/34 of the Indian Penal Code.

As per F.I.R., allegation is against the Director and Principal of Imamul Hind Academy, Bhebhra Chowk, Jokihat with regard to misappropriation of scholarship amount of the students and name of the petitioner transpires during investigation. Submission of the learned counsel for the petitioner is that the petitioner has been made accused only because he is the brother of the Principal and the Director of the said Academy and moreover the Principal has deposited the said amount through different cheques, as stated in para-14 of this petition. Learned A.P.P. opposes the prayer for bail.

Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, surrenders be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- VI, Araria in connection with Jokihat P.S.Case No. 326 of 2016, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
