JUSTICE MOHIT KUMAR SHAH ORAL ORDER 29-11-2023 The present writ petition has been filed seeking the following reliefs:- "1.(i) For issuance of an appropriate writ /order/ direction to quash the letter bearing memo no. 7810 dated 03.09.2021 by which the appointment of petitioner on compassionate ground has been rejected saying that the petitioner doesn't come under the deponent of the deceased in view of letter no.

7146 dated 31.10.2008 issued by General Administration Department, Patna. Government of Bihar, Patna.

Patna High Court CWJC No.5002 of 2022(2) dt.29-11-2023 2/2 (ii) For issuance of an appropriate writ / order respondent / to direction to the treat the elder unmarried brother as deponent of deceased Government Employee on Compassionate Ground.

(iii) For issuance of an appropriate writ/order/direction to the respondent to consider and make appointment of petitioner on compassionate ground as the petitioner is unmarried elder brother of deceased employee."

After some arguments, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the scheme of compassionate employment, issued by the Personnel and Administrative Reforms Department, Government of Bihar, Patna vide notification dated 31.10.2008. Liberty, so sought, is granted.

The present writ petition stands disposed off.
