Due to the case being under Section 302 of the Indian Penal Code and the petitioners being named in the First Information Report, let them surrender and pray for regular bail as the Court is not inclined to grant an order under Section 438 Cr.P.C. in connection with Banka P.S. Case No. 46 of 2014, pending before the learned Chief Judicial Magistrate, Banka.
The prayer for bail of the petitioner under Section 438 Cr.P.C. is dismissed.
However, if the petitioners surrender and pray for regular bail, that must be considered strictly as per the material available in the case diary.
