JUSTICE SANJAY PRIYA ORAL ORDER 06-12-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Chainpur P.S. Case No. 253 of 2016 instituted for the offence under Section-307 & other minor Sections of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected by order dated 03-04-2017 passed in Cr. Misc. No. 4393 of 2017 with liberty to the petitioner to renew his prayer for bail after six months if no substantive progress is made in the case.

A report was called for from the court below, which has been received.

The court below has submitted in the report that case is still pending for appearance of the accused and the same has not been committed to the court of Sessions.

In such circumstances, the prayer for bail is allowed. The

Patna High Court Cr.Misc. No.51247 of 2017 (3) dt.06-12-2017 petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chainpur P.S. Case No. 253 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua subject to condition that both the bailors should be close relative of the petitioner.
