The petitioner is in custody in connection with Kalyanpur P.S. Case No. 278 of 2019 for the offences under Sections 341, 323, 324, 307, 354(b), 379, 452, 504, 506, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and he is in custody since 19.12.2018.

Learned counsel for the informant submits that in the instant case injury is grievous and as such petitioner does not deserve bail.

Patna High Court CR. MISC. No.16942 of 2019(2) dt.25-03-2019 2/2 Learned counsel on behalf of petitioner submits that the injury sustained by Rajpati Devi is attributed to Ajit Kumar and not the petitioner.

Considering the fact that petitioner has no criminal antecedent, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Court of learned Chief Judicial Magistrate, Motihari, District- East Champaran in connection with Kalyanpur P.S. Case No. 278 of 2019.
