JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Lakhisrai P.S.Case No. 260 of 2017 registered under Sections 302,201 and 120B/34 of the Indian penal Code. Allegation in brief is that while informant's husband was going on by a tractor to fill soil, accused persons followed him saying that today he would be done to death.

Learned counsel for the petitioner submits that dead body was found after two days of his disappearance and the petitioner is neighbour and due to some petty dispute, earlier also a case against the informant's side was lodged and therefore, petitioner has been falsely implicated in this case and he has got clean antecedent and some of the similarly situated co-accused persons were admitted to anticipatory bail and one another co-accused

Patna High Court Cr.Misc. No.59362 of 2017 (4) dt.23-01-2018 2/2 person has been admitted to regular bail by a co-ordinate Bench of this Court vide order dated 06.12.2017 in Cr. Misc. No. 57059 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Mohan Mandal to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai P.S. Case No. 260 of 2017.
