Petitioner, already in custody, seeks bail in connection with Neema Chandpura P.S. Case No.18 of 2018 registered under Sections 302 and 34 of the Indian Penal Code. Allegation in brief is that the petitioner's younger brother was assaulted by the accused persons by iron rod and knife due to previous enmity causing his death. Learned counsel for the petitioner submits that there is general and omnibus allegation against the accused persons, however the informant appears not an eye witness and the petitioner has been in custody since 08.03.2018; whereas learned counsel for the State submits that there is allegation that all the four accused persons indiscriminately assaulted the
Patna High Court Cr.Misc. No.43016 of 2018(2) dt.17-07-2018 2/2 deceased with iron rod and knife and twelve injuries were found on the person of the deceased.
Having considered the aforesaid facts and circumstances, the Court is not persuaded to grant bail to the petitioner at this stage. Accordingly, the prayer of the bail of the petitioner is rejected.
