The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 406, 409, 420/34 of the Indian Penal Code. The prosecution case as per F.I.R is that Rs. 7,00,000/- was sanctioned for constructing the school building but the petitioner being Secretary of Vidyalaya Shiksha Samiti and co-accused Umesh Rai being Headmaster of the school have misappropriated Rs. 2,50,592/- out of the total amount of Rs. 7,00,000/-.

No.17705 of 2022(2) dt.19-09-2022 2/3 It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has falsely been implicated in this case. It is also submitted that the petitioner is an illiterate lady and the whole authority to withdraw money for construction work was upon the co-accused. It is further submitted that No Dues Certificate has already been issued by the District Programme Officer, Bihar Education Project, Darbhabga in which it was stated that the whole work has been done as gets reflected from Annexure-4 of the petition. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial
