JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20.07.2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under section 7 of the Essential Commodities Act.
One truck laden with 88.5 quintal rice was seized by the police officials and after that present case was registered against the driver of the truck and owner of the seized rice.
It is submitted on behalf of the petitioner that after one year of institution of the above stated case, the name of this petitioner came in this case on the basis of supervision note of DIG. He submitted that prior to supervision of DIG,
Patna High Court Cr.Misc. No.43529 of 2018 (2) dt.20-07-2018 driver of the aforesaid truck was arrested and disclosed before the police that seized rice belonged to other person. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Sub divisional Judicial Magistrate, Saran at Chapra in Sonepur P.S. Case no. 35/2013.
